One United States Appeals Court just overturned the sales ban on the Samsung Galaxy Nexus on the grounds that the California district court “abused its discretion.” The case revolved around a patent conflict over search functions like Siri and unified search. Now it turns out that Judge Lucy Koh may have to reverse her decision.
The ban was only allowed in the case that Apple could prove beyond a doubt that Samsung had done “irreparable harm” to their sales. Since Apple couldn’t really prove this to satisfaction, the ban is being lifted. So rejoice all you would be buyers of the Galaxy Nexus and lovers of free market competition! Samsung will be able to put the Galaxy Nexus back in stores as fast as they can ship them.
